TOTALLY INDEPENDENT & FULLY COMPREHENSIVE(Our conveyancing service is also available for the private purchaser, or vendor, acting without an estate agent)1. We draw up a Private Sales Agreement stating clearly the terms and conditions of the transaction.
2. We ensure that there is clear title to the property, prior to the Title
Deed (Escritura) being signed.
3. We obtain a certificate (Nota Simple) from the appropriate Land
Registry, to determine there are no mortgages or embargoes.
4. We arrange settlement of any outstanding mortgages or embargoes.
5. We
obtain a Certificate of Non-Residency, if applicable, and
"N.I.E." numbers, if required
6. We ensure that there are no inherited debts, by confirming that
Community Fees, electricity, water, rates, etc., are paid to date.
7. We present all necessary papers to the Notary prior to signing Title
Deed.
8.
We ask the Notary to prepare the Title Deed for signing and ensure
declared values are correct and in line with tax authority valuations.
9. We arrange an appointment with the Notary, the Purchaser and the
Vendor, to sign the Title Deeds.
10.
We arrange secure and precise Power of Attorney, should either party be
unable to attend the Notary personally.
11.
We arrange translation of the Title Deed for both parties.
12.
We assist with setting up bank accounts, if required, and arrange
payments by confirmed bank drafts upon signing the Deeds.
13.
If the vendor is non-resident we arrange deduction and payment of 5% retention of the declared value
for Capital Gains tax to the "Tesoro Publico", on behalf of the
Vendor, and arrange the claim for refund after assessment.
14.
We arrange transfer or re-patriation of funds, if required.
